Chessline Terms of Service - User Agreement

1. Acceptance of Terms

By accessing or using ChessLine, you agree to be bound by the terms and conditions of this User Agreement ("Agreement"). If you do not agree to these terms, you must refrain from using ChessLine.

2. Definitions

  • ChessLine: Refers to the ChessLine platform, including its website, mobile application, and any related services.
  • User: Any individual accessing or using ChessLine.
  • Service: The guidance, recommendations, and functionalities provided by ChessLine.
  • Content: Any materials, including text, images, and data, provided by ChessLine or contributed by users.

3. Purpose of ChessLine

ChessLine is designed to provide general information and advice on chess strategies and tactics. It is not a substitute for professional coaching or guaranteed to ensure success in chess games or competitions.

4. Eligibility & Account Registration

  • Users must be at least 13 years old to access ChessLine. If under 18, parental consent is required.
  • Users must provide accurate and complete information when creating an account.
  • Users are responsible for maintaining the confidentiality of their login credentials and agree to notify ChessLine immediately of any unauthorized use.

5. Disclaimer of Liability

ChessLine does not guarantee the accuracy, completeness, or reliability of the information provided. Users assume full responsibility for their use of the service. ChessLine specifically disclaims liability for:

  • Financial losses: ChessLine is not responsible for financial losses resulting from chess-related decisions, including monetary bets or online tournament participation.
  • Emotional distress: ChessLine is not liable for any frustration, disappointment, or stress arising from chess performance.
  • Third-party actions: ChessLine is not responsible for the actions of other chess players, third-party platforms, or online services.
  • Data loss & unauthorized access: ChessLine does not assume liability for any data loss, account hacking, or unauthorized access beyond its reasonable control.

6. Indemnification

Users agree to indemnify and hold ChessLine, its affiliates, and employees harmless from any claims, losses, liabilities, or expenses (including legal fees) arising from misuse of the service, violations of this Agreement, or infringement of third-party rights.

7. Prohibited Activities

  • Use ChessLine to harass, threaten, or intimidate others.
  • Engage in illegal activities or violate applicable laws and regulations.
  • Distribute, copy, modify, or exploit ChessLine's intellectual property without authorization.

8. Privacy & Data Collection

By using ChessLine, you consent to the collection and use of personal data as outlined in our Privacy Policy. ChessLine only collects data necessary for service improvement and does not share user information with third parties without explicit consent, except as required by law.

9. Intellectual Property

All content on ChessLine, including text, graphics, and software, is protected by copyright and intellectual property laws. Users may not reproduce, distribute, or modify content without prior written permission.

10. Payment & Refund Policy

  • ChessLine may offer free and paid subscription plans. Payment terms, renewal policies, and cancellation procedures are outlined in the pricing section.
  • The currency for all transactions is clearly stated before checkout.
  • Refunds are only provided for billing errors or service unavailability exceeding 14 consecutive days.
  • Users must contact customer support for payment disputes, and all refund requests will be processed within 7 business days.
  • ChessLine reserves the right to suspend or terminate access if payment issues arise, such as chargebacks or fraudulent transactions.

11. Compliance with Payment Providers

Payments for ChessLine services are processed securely through Stripe. By using our service, you agree to Stripe's Terms of Service and Privacy Policy. ChessLine does not store payment card details, and all transactions are subject to Stripe's security and compliance measures.

12. Third-Party Content & Links

ChessLine may contain links to third-party websites or content. ChessLine is not responsible for the accuracy, policies, or practices of any third-party services.

13. Service Modification & Availability

ChessLine does not guarantee uninterrupted availability of the service. The platform may experience downtime for maintenance or updates.

ChessLine reserves the right to modify, suspend, or discontinue features at any time without prior notice. ChessLine is not liable for any disruptions or losses incurred due to service interruptions.

14. Termination of Use

ChessLine reserves the right to terminate or suspend user access at any time, with or without notice, for any reason, including but not limited to violations of this Agreement.

15. Amendments & Notification

ChessLine may modify this Agreement at any time. Updates will be communicated via the website or email notifications. Continued use of ChessLine after modifications constitutes acceptance of the revised terms.

16. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts in Basel-Stadt. Users agree to resolve disputes through informal negotiations first. If unresolved, arbitration may be pursued as an alternative to litigation through a recognized Swiss arbitration body.

17. Force Majeure

ChessLine shall not be held liable for delays or failure in performance due to unforeseen circumstances beyond its control, including natural disasters, cyberattacks, or government-imposed restrictions.

18. Entire Agreement

This Agreement constitutes the entire understanding between the user and ChessLine, superseding all prior agreements, whether oral or written.
